Virual Event TERMS OF USE

The EMPHORO virtual event terms of use include this Terms of Use and the Privacy Policy. The following terms of use apply to the virtual event delivered to you via EMPHORO servers, over the internet, and hosted by the virtual event sponsor. By entering the virtual event you agree to the Terms of Use; if you do not agree to the Terms of Use, do not enter the event.

EMPHORO (or “we”) may update or modify the Terms of Use at any time and without notice to you. EMPHORO is not responsible or liable for any of the event sponsor’s policies, and may terminate any part of the virtual event without notice and at any time.

You may access and participate in the virtual event, provided that you:

• Create a user account, or sign in using a third party service such as Linked-in, Facebook, or Twitter
• Are over the age of 13, or have parental permission to use the website
• Do not participate in any illegal activities during the event
• Comply with all applicable local, national, and international laws and the Terms of Use

Content and Trademarks

The content provided on the virtual career fair platform are the property of EMPHORO or the sponsor. No license or other right to such materials is granted to you. You may not copy or distribute any of the materials.

You may also be exposed to other submissions from users. EMPHORO is not liable to you for any other user’s actions. You agree to waive any legal or equitable rights you have or may have against EMPHORO.

Video Interviews and Technical Challenges

As a participant, you have the option of participating in a video interview or technical challenge. You give permission for the company upon which you submit your challenge to view it and share it internally. If you take a challenge, you grant us permission to show your results to top companies.

Database Search

If you fill out a candidate profile, employers will be given access to information to search the database for your skill set and contact you. You give permission for us to release your contact information to employers.

 YOU AGREE THAT YOUR PARTICIPATING AT A VIRTUAL EVENT SHALL BE AT YOUR OWN SOLE RISK.

LIMITATION OF LIABILITY.IN NO EVENT SHALL EMPHORO BE LIABLE TO THE USER FOR ANY LOST PROFITS OR FOR ANY INCIDENTAL, PUNITIVE, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF DATA, LOST SAVINGS OR OTHER SIMILAR PECUNIARY LOSS), HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY (INCLUDING NEGLIGENCE) AND WHETHER OR NOT KARMAHIRE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.  IN NO EVENT SHALL KARMAHIRE’S AGGREGATE LIABILITY FOR DAMAGES ARISING OUT OF OR RELATED TO THIS AGREEMENT EXCEED THE FEES PAID BY CUSTOMER IN THE TWELVE (12) MONTHS PRIOR TO THE DATE ON WHICH THE CLAIM AROSE.

Indemnity

You agree to defend, indemnify, and hold harmless EMPHORO, the event sponsor, and their respective officers, directors, employees, affiliates and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your use of and access to the virtual event, including your violation of the Terms of Use, and third party’s intellectual property rights, damages arising out of your submissions, and any other act or omission.
